I explained to the occupational therapist that there was a mix up and that unilaterally scheduled the appointment during my parent time. I told her that if it is necessary for Trent to go to OT on Monday during my parent time that I will support that. She said it it not necessary and she indicated that it is counter productive to work with a child who is missing out on fun events during my parent time that we’re always doing. She indicated that the Monday appointment can be cancelled and rescheduled for a time that does not cause parent time conflict. She told me to talk to you and work out the next appointment. You need to reschedule for another day, not during my parent time. She said the most important thing is to work with Trent on the exercises in between sessions. I’m willing and able to support Trent in doing those exercises. You have not informed me of those exercises. If you want to coparent then you need to inform me of such things. Also the occupational therapist indicted that only four sessions are indicated at this time. There is plenty of time for those sessions to be completed later. The most important things is the exercises between sessions, that is where the real progress is gained. I’m available on Monday to be with the kids, therefore I am entitled to the parent time. When I pick up the children on Monday is not your choice. I will pick up the children at 3:00pm either at the school or your house. Which do you choose?
And October 1 won’t work for me.

Hi, Chuck, the sunrise this morning was breathtaking!
I’m so confused, haha (see screenshots). If you changed your mind and you don’t want to be involved, no worries. Just let me know and I’ll pass that along to the OT.
Thanks so much. I’m grateful we can work together.

Hi, Chuck, can you believe the school year is almost over! It’s crazy!
I talked with Dr. Alley today. He’s recommending that Trent do occupational therapy once a week until the end of 2021. Trent needs a lot of extra help to improve his small motor skills and physical processing. I put his appointments on the OFW Calendar.
I appreciate that we can work together. Thank you so much!

Maureen, I will be more careful about what I agree to from now on. I would like to be on the same page about medical decisions. We have joint legal custody when it comes to medical decisions. You have made significant medical decisions without my input or consent including taking Trent to OT without notice/ detailed information. Please keep me informed and seek my input and consent prior to making such decisions. What if I just started making medical appointments without asking you?
The challenge with swimming is that it needs to be scheduled when everyone is available. I wish it could have been ironed out and planned many weeks ago, but that is not how it happened. It is great that you are capable of planning events months and years in advance. However, that is not always possible. It appears that we both need to be flexible. On numerous occasions you have informed me last minute about parties or events the children have been invited to. While I have no way of knowing whether it was possible for you to give me more advanced notice, I have been adaptable and I have cancelled plans and rearrange my schedule to accommodate those events. I kindly request that you offer the same flexibility. I will pick up the kids at 3 on the 30th. Thanks, Chuck

Hi, Chuck, the sunrise this morning was beautiful! I hope you were able to see it. I’ll be able to respond probably on the 30th. Sorry, I don’t have time to give this the thought it deserves until then.
Thanks so much. I’m grateful we can work together.

Maureen, Ty says he has a baseball game tonight? Stop manipulating the kids to take baseball.
Historically, you do not ask me for my input about the extra curricular activities. You unilaterally decide on their activities, sign them up and then request reimbursement. And then you don’t give me any information about any of their games or their coaches information. I am under no obligation to pay for activities I do not agree to. I am not looking to be the one who decides. There must be mutual agreement.
I do not agree to baseball for the boys. I do not agree to soccer for Sloan. The children’s talents and skills are in other activities. The boys do not have intrinsic motivation to practice or improve at baseball. They go to baseball because you insist on signing them up. However, there are better uses of their time and our money. What are they passionate about? What gets them excited?
Ty enjoys trombone. His lessons are extracurricular; they are not required. Ty enjoys and excels at STEM based activities and pursuits. Ty is a strong biker and climber and he enjoys both and gets excited about them.
I think Trent has potential as a wrestler. While he has struggles with his fine motor skills he has great strength and grit that could serve him well in wrestling and/or weight lifting for example. Perhaps there are other athletic interests he has. He excels at history, weapon history and enjoys computers.
Sloan is a very strong climber and biker and she gets super excited about it. She also loves dance. I see dance / acro/ tumbling as a good fit for her. Piano is not a good fit for Sloan at this time. She is not motivated to practice and even resists it. We have informed her piano teacher that she will be discontinuing piano after next week.
I would appreciate your understanding on these points.

Chuck, isn’t this break from the heat wonderful!
Sounds like you want to interpret trombone as Ty’s one extra-curricular activity you support (if you’ll support only one). That’s great! As for climbing, awesome! Climbing camp was their one extracurricular activity in June. Thanks for paying those via OFWPay (see screenshots).
At my house, Ty and Trent practice baseball in our backyard and with friends all the time. It’s so fun to watch them:). If you send over some details about what’s stopping them from playing baseball at your place, let me know, maybe I can help you problem solve.
As for wrestling, I’m not familiar with the programs around here. Let me know what you find out.
I’m so sorry you’re struggling with your memory. I forget things sometimes too. Maybe it will help if you put the term “dr” into the search bar on the messages in OFW, you’ll see them all listed (see screenshot). I’ve attached just a few examples, hopefully those screenshots will jog your memory. Similarly, everything is listed on the calendar and contact into in the info bank.
You mentioned on August 24, 2021 that you’re willing to make some medical appointments. Thank you, yes, go ahead and start making medical appointments for the kids. Let me know when they are and if I can make it, I’ll come too.
I talked with Sloan and she really wants to continue piano. So I talked with Ms. Traci. We were both laughing that had our parents pulled us out of piano for not practicing we would have never learned, haha. So I’ll continue taking to her lessons and log the expenses in OFW.
I’m afraid Trent and Sloan won’t be home to be picked up at 3PM on the 30th. Trent will be at baseball and Sloan will be at her friends. So let’s stick to 6PM pick up time.
Let me know if there is anything else I can do to help. I’m grateful we can work together.

Morning, Chuck, it looks like it will be a beautiful day today! Sloan’s stomach was hurting her so badly today she didn’t want to go to pre-school or kindergarten. I was able to gently convince her to go, but she called and said it still hurt and she wanted to come home. It is a struggle every morning she comes home from your parent time.
I’m taking her into Dr. Alley to see what’s going on. The appointment is on Tuesday at 3:45PM if you’d like to join us.
I’ve also made an appointment with her child psychologist, Dr. Gold to see if it’s stress related. That appointment is on Thursday at 9:00AM. Again, feel free to join us.
I’ve added these appointments to the calendar.
Thanks so much!

Hey, Chuck, it was so cold today! I love hot chocolate weather. Thanks for letting me know you’re unavailable March 15.
Dr. Alley is concerned that Sloan is experiencing a lot of emotional stress during your parent time on the weekends. Please contact him if you have any questions.
And Dr. Gold is counseling all the children to be assertive about what they want and need. Hopefully they’ll let you know when they see you next, but if you want assistance, please contact Dr. Gold.
Thanks so much!

Hey, Chuck, the rain today was delightful!
Dr. Gold is concerned that Trent my have something else going on. He’s referred us to a pediatric clinical psychologist who does testing named Dr. Dorthy. Dr. Gold wants Dr. Dorthy to do a full battery of tests to see if Trent has any diagnosable congitive disorders.
She is booked way in advance, so the soonest I was able to schedule his appointment was August 13, 2019 at 8:30AM. The test goes for 6 hours! It’s crazy! Anyway, as you know Dr. Gold’s info is in the info bank, and I put Dr. Dorthy’s into there too. If you have any questions, please reach out to them.
Thanks so much!

Hey, Chuck! Thanks so much for taking the kids this weekend. Beth and I are going to hike Tom’s Peak tomorrow. I’m excited to check that off my bucket list!
We got the results back from Dr. Dorthy. Trent has a severe processing disorder – in his case, it means that he’s super smart, but his brain doesn’t communicate with the rest of him as fast as a typical person. Dr. Gold and Dr. Alley have suggested that the first thing is to determine if there is a physical cause, like a too much water in his brain or abnormal brain activity that could be treated.
So they’ve referred us to a pediatric neurologist at the children’s hospital named Dr. Becker. She’s booked out super far in advance, so the soonest I could get an appointment is April 20, 2020 at 2:00PM at the children’s hospital. I made the appointment and we hope you can make it. If you have any questions, contact Dr. Alley.
Thanks so much!

Hey, Chuck, I love this spring weather. It’s so fun to see all the flowers blooming! I wanted to let you know about our appointment with Dr. Becker, I’m so sorry you couldn’t make the appointment.
She agrees with Dr. Alley and Dr. Gold that Trent’s processing issues could have a physical cause, and therefore a physical treatment. So she’s ordered an EEG. The EEG is scheduled at the children’s hosptial imaging on October 15 at 10AM. We’d love it if you could make it, so you can make sure to ask Dr. Becker all your questions.
Thanks so much!

Chuck, what a snowstorm! Ty had to go to the instacare last night and have a nebulizer treatment for inflamed lungs. The dr there things that Ty might have allergies that could be treated by allergy shots, so he recommended we get him allergy tested. Dr. Alley agrees, so I set up an appointment for Ty to get tested on February 16 at 8:30AM. Give Dr. Alley a call if you have any questions.
Thanks so much!

Chuck, what a beautiful cool morning! Thanks for your response. To open the attachments, hover over the icon and then click.
My attorney is worried you’re falsifying calculations to pay less child support. I told him you just probably didn’t understand that once the decree sets forth the child support amount, that’s the amount.
The attorney let me know how much you owe in back child support and I logged it on OFW expense log for via OFWPay.
He’s also concerned that you’re in contempt of the decree for not sharing the cost of at least one extracurricular activity per child, per season, the kid’s devices and the other logged expenses that should be covered as per the decree.
Anyway, as soon as those payments are up to date, I’ll be able to add you as a contact on their devices watches. I’ve been wanting to do that for years and it looks like I’ve messaged 20 times about it, haha (see screenshot).
Thanks so much for bringing this up. It’s great to be able to resolve these issues:).

Maureen,
I spoke with a family law attorney, he is very familiar with your attorney, about the interpretation your attorney and you are asserting.
I now know that there are two scenarios or conditions where automatic reduction in support applies. First, the interpretation that the Automatic Reduction of Support applies to summer extended parent time is correct with regard to the portion of the law and decree that states “Pursuant to UTAH CODE ANN. §78B-12-216, Respondent’s base child support obligation shall be automatically reduced by: … b. Twenty-five percent (25%) for each child for time periods during which the child is with the Petitioner by order of the Court… for at least twelve (12) out of any thirty (30) consecutive days of extended parent time. “
The Order of the Court operating here is the decree of divorce and specifically the provision that governs summer extended parent time. In previous years I was ignorant of the fact that the summer extended parent time I have used applies towards reducing my support. Knowing that now, I have overpaid support during each of those summers dating back to 2017.
The second condition or scenario where automatic reduction of support is applies occurs when, “Pursuant to UTAH CODE ANN. §78B-12-216, Respondent’s base child support obligation shall be automatically reduced by: . . . or b. Twenty-five percent (25%) for each child for time periods during which the child is with the Petitioner by . . . or by written agreement of the parties for at least twelve (12) out of any thirty (30) consecutive days of extended parent time.”
The use of the conjunction “or” establishes alternatives – one alternative is court order and other alternative is mutual agreement. Therefore, for parent time that is by mutual agreement and meets the definition of “time periods during which the child is with the Petitioner . . . for at least twelve out of any thirty (30) consecutive days of extended parent time”.
In our situation, we have a written mutual agreement that I would have the children for an extended period of time which meets the definition of the decree and the statute for Automatic Reduction of Support.
It was also brought to my attention that the statute and the decree provide ” b. Twenty-five percent (25%) for each child”. The critical distinction here is “each child”. Here, technically, the reduction calculation comes out to a 75% reduction because there are three children.
Regarding the children’s devices. If I pay half will I get access to their devices and the accounts associated with them? I think their devices have location monitoring services. If I pay half I want equal access and benefits that you have.
Also, I don’t see why I have to pay for months in the past where I did not have access or utilization of the ability to communicate with them through their devices. That does not seem reasonable or fair.
I would like to come to mutual agreement about what it will cost me and the access I will have. I am willing to pay half of the original device cost / activation fee and half of the monthly service for months where I have equal access to their devices, the accounts, and ability to communicate with them using my phone, Jill’s phone and otherwise utilize the benefits that you have due to the children’s possession of the devices (watches / phones).
Thanks,
Chuck

Hey, Chuck! Did you see that sunset? It was gorgeous.
I appreciate you sending this! I can’t really process this message, as I’m not an attorney, haha. I’ll just continue to track everything my attorney says is covered by the decree. We can settle up later. No worries.
As far as the devices go, you’ll have access to the devices as soon as you pay for half. Search “devices” to see the history there. Or would you rather I add all the screenshots? Either way, let me know.
By the way, the Christmas break parent time doesn’t look right on calendar. Just wanting to get that finalized so we can make plans.

Maureen,
Well, I have 2022 Spring break from March 25 at 6PM to April 4 drop off at school. That is 9 days, 14 hours, 30 minutes.
You get the Fall break this year from October 13th at 6PM to October 18rd at 8:30AM. That is 4 days, 14 hours, 30 minutes.
You get an end portion of Winter break, December 30th at 9:00AM to January 3rd at 8:30PM. That is 4 days, 11 hours, 30 minutes. Fall break time plus the end of Winter break time equals 9 days and one hour. That appears to be an even swap for Spring break.
Does that work?
Thanks,
Chuck

Hahaha, Chuck! I love it. That’s perfect. Your jokes about the hours and minutes are cracking me up.
Since fall break ends Oct 22 at 8:30PM (the professional teacher day is just counted as a school day since it’s on the district calendar), your proposal doesn’t cover it down to the exact hours and minutes. You’re missing bee-do, bee-do, oh, wait I can’t do math, haha!
Does picking up Mar 25 at 6PM, bringing them home April 3 at 8:30PM work?
Thanks so much! Again, I’m just so grateful we can work together!
